Terms and Conditions
§1 Scope
These Terms and Conditions apply to all contracts between

– hereinafter referred to as “the Provider” –
and customers purchasing goods via the Arts & Gallery online shop.
§2 Offer and Conclusion of Contract
(1) The products displayed in the online shop do not constitute a legally binding offer but an invitation to place an order.
(2) By clicking the button “Buy now” or “Place order with obligation to pay”, the customer submits a binding offer to purchase.
(3) The contract is concluded once the Provider accepts the order by sending an order confirmation via email or by dispatching the goods.
§3 Products, Unique Pieces and Representations
(1) Some of the works offered are handcrafted unique pieces or limited editions.
(2) Images in the online shop serve illustrative purposes. Minor deviations in color, structure or material may occur due to handcrafted production and do not constitute a defect.
(3) In the case of artworks, handcrafted objects and unique pieces, natural variations in structure, surface or patina may occur. These are inherent to the artistic or artisanal process and do not constitute a defect.
§4 Prices and Shipping Costs
(1) All prices are final prices and include applicable value added tax (VAT).
(2) In addition to the stated prices, shipping costs may apply. These will be clearly indicated during the ordering process.
(3) Deliveries are currently limited to the countries specified in the online shop.
§5 Payment
(1) The available payment methods are displayed in the online shop.
(2) The purchase price is due immediately upon conclusion of the contract.
(3) In the event of late payment, the Provider reserves the right to charge statutory default interest.
§6 Delivery
(1) Delivery is made to the address specified by the customer.
(2) Delivery times are indicated in the online shop and are to be understood as non-binding estimates unless expressly agreed otherwise.
(3) Partial deliveries are permitted insofar as they are reasonable for the customer.
§7 Retention of Title
The goods remain the property of the Provider until full payment has been received.
§8 Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal.
Further information is provided in the separate right of withdrawal policy.
§9 Warranty
(1) The statutory warranty rights apply.
(2) In the case of handcrafted artworks, characteristics typical of the material or production process do not constitute a defect.
§10 Liability
(1) The Provider shall be liable without limitation in cases of intent and gross negligence.
(2) In cases of slight negligence, the Provider shall only be liable for the breach of essential contractual obligations and limited to foreseeable damages.
(3) Liability under the German Product Liability Act remains unaffected.
§11 Copyright
(1) All works, texts and images presented are subject to copyright.
(2) The purchase of an artwork does not include the transfer of any usage or exploitation rights unless expressly agreed in writing.
§12 Final Provisions
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction is, to the extent legally permissible, the registered office of the Provider.
(3) Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
